Abstract

The embedded finance phenomenon demonstrates a paradigm shift in the financial industry that increasingly prioritizes ease of access (seamless financial services). This business model not only benefits consumers through increased transaction efficiency but also opens up new opportunities for businesses to expand services and increase customer loyalty. The purpose of this article is to determine how the legal analysis of Sharia compliance in the embedded finance fintech business model is carried out from the perspective of Sharia economic law. This research uses a normative legal research method (normative juridical). Normative legal research focuses on the study of applicable legal norms through an analysis of laws and regulations, legal principles, doctrines, fatwas, and various literature related to the research object. The results of this research are: first, strengthening the certainty of Sharia law is necessary through a comprehensive legal analysis of laws and regulations, fatwas of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI), and the principles of Sharia Economic Law that serve as the basis for implementing Sharia-based financial transactions.  Second, strengthening Sharia compliance in embedded finance operational mechanisms requires a comprehensive review of the contract structure, transaction mechanisms, fund management, distribution of rights and obligations of parties, and the operational systems used in the provision of digital financial services. Third, strengthening Sharia compliance oversight and legal protection requires ongoing synergy between regulators, the Sharia Supervisory Board (DPS), the Financial Services Authority (OJK), Bank Indonesia, and the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) in developing an integrated supervisory mechanism for embedded finance.
