Abstract

The development of information technology has driven significant transformation in the financial sector, particularly through the presence of Financial Technology (Fintech). One form of fintech innovation that is growing rapidly in Indonesia is Peer to Peer Lending services, namely platforms that bring together lenders and borrowers directly through an electronic system. The purpose of writing this article aims to analyze the protection of customer personal data in Sharia-based Peer to Peer Lending services in Indonesia. This study uses a qualitative approach with a normative juridical type to analyze the protection of customer personal data in Sharia-based Peer-to-Peer Lending services, as well as the legal implications due to the gap between regulations and practices in Indonesia. The results of this study are firstly compliance with Peer to Peer Lending Services, compliance with Sharia-based Peer to Peer Lending services in Indonesia can be seen from two main aspects, namely compliance with positive legal regulations and compliance with the principles of Sharia economic law.  Second, strengthening regulatory implementation. Although Indonesia already has Law Number 27 of 2022 concerning Personal Data Protection as the legal basis for personal data protection, the main problem in peer-to-peer lending services lies not in the lack of regulation, but rather in its suboptimal implementation. Third, public education and literacy can be achieved by providing an understanding of the characteristics of illegal fintech companies and the importance of caution in granting access to personal data to digital applications.
