Implementasi Akad Musaqah pada Pengelolaan Perkebunan Kopi di Kecamatan Batu Brak Kabupaten Lampung Barat

Abstract

This study analyzes the implementation of musaqah contracts in coffee plantation management in Batu Brak District, West Lampung Regency, using a descriptive qualitative approach through literature review. The findings indicate that musaqah contracts, which are generally oral, fulfill the pillars of Islamic jurisprudence (fiqh) such as the ijab-qabul (contract of sale) and the specification of coffee plants, with a 50:50 or 60:40 profit-sharing system that increases the productivity of idle land and communal solidarity. This practice aligns with Islamic economic principles as mandated by the DSN-MUI fatwa No. 4/2000, although there are minor deviations, such as the inclusion of elements of ijarah due to the lack of written documentation. Literature analysis from scientific journals and previous theses confirms the benefits of musaqah in empowering coffee farmers and avoiding usury and gharar compared to conventional methods. The study recommends sharia literacy training, local MUI fatwas, and digital contracts for sustainable optimization.
